Release of Maritime State Concessions

The North Adriatic Sea Port Authority has jurisdiction over the state-owned maritime port areas (Ministerial Decree 6 April 1994) which include:

Maritime state water areas and canals located between the Malamocco and Lido inlets (Malamocco Canal, South/West/North/Brentella Industrial Canals, Vittorio Emanuele, Giudecca Canal, San Marco Basin, Navigation Canals, and San Felice Canal).

State property areas along the edges of the maritime canals.

Areas, parking lots, port facilities, and buildings (state property extensions or private works within state property areas) in Porto Marghera, Mira, Venice Historic Center, Cavallino Treporti.

By a decree dated March 21, 2014, the territorial jurisdiction was expanded to include the Offshore Platform area (located at coordinates Lat. 45° 17.3′ N – Long. 12° 30.4′ E WGS84), its associated maneuvering basins, water areas, and complementary roads, the major navigation canal connecting it to the Malamocco port inlet, and the connection areas at sea and on land for the passage of installations and connection infrastructure.

Finally, as of Legislative Decree No. 169 of August 4, 2016, and the subsequent Ministerial Decree No. 64 of March 7, 2017, establishing the Port Authority of the Northern Adriatic Sea, the state property district, previously managed by APV, was expanded to include the Chioggia port area.

The Port Authority manages the concession of these areas for port-related activities, development, and the use of maritime state property, whether on the surface or subsurface/sub-bottom/overhead (for laying pipelines). It also manages authorizations for works within 30 meters from the boundary of the maritime state property.

Types of Maritime State Property Concessions

Maritime state property concessions, granted through administrative acts, fall into the following categories:

  • Temporary for contingent reasons (e.g., construction sites or events) with a duration of less than a year.
  • Infraquadrannial with a duration ranging from one to four years.
  • Multiyear with a duration exceeding four years.
  • Authorizations granted for carrying out works on maritime state property areas and for the execution of new works on private land within 30 meters of the state property boundary, as per Article 55 of the Navigation Code.
